Court Awards N10m Compensation to Jennifer Adun for Inhuman Treatment

A High Court sitting in Benin has awarded the sum of 10 million naira to Jenifer Adun  as compensation for the inhuman treatment meted out to her by the Respondents and ordered the Respondents to remove forthwith the said viral video from all forms of social media immediately and pay the applicant the sum of 10m within 30 days from 25th February,  2022.

The presiding Judge, Hon. Justice Courage Ogbebor awarded the sum of 10 million Naira as compensation to the applicant ( Jennifer Adun).

Jennifer Adun was 18 years of age when she was taken to Litmus  Suit &  Hotel by some so called Big Boys in 2018 who claimed she stole the 1st Respondent’s Iphone 7 and took her to their home for three days, locked her up, stripped her completely naked, tied her two hands backward and put a tyre round her neck while threatening to burn her alive. They made video recording of her and circulated the video in several social media platforms.

The applicant who was represented by the law Firm of West-Idahosa & Co., (SAN) filed a suit to enforce her fundamental human right.  On  behalf of the applicant, the Law firm argued that the act of the Respondents amounted to a breach of the fundamental rights of the applicant as enshrined in sections 34, 35 & 46 of the 1999 constitution (as amended) and urged the court to award the cost of 100 million Naira in favour of the applicant for the emotional and psychological trauma that the applicant went through in the hands of the  Respondents.

After taken  arguments from counsel to both parties and watching the viral video in open Court, the trial Judge delivered her Judgement on 25th February, 2022 and found in favour of the applicant and awarded the sum of 10 million naira as damages and ordered the immidiate removal of the said viral video from all  forms of social media. The court also ordered that the damages awarded should be paid to the applicant within 30 days.

The applicant was represented in court by Famous Osawaru Esq., on behalf of the law firm of West-Idahosa & Co., (SAN).
